The guy wasn't even a US citizen or even a US person. He was a foreign national on a military base, he had NO CONSTITUTIONAL RIGHTS.

the issue is actually one of does the NSA or other covert network admit they already have the directory and password? What they are doing is trying to establish a publicly facing chain of ownership and proper investigative technique where they are able to defeat the encryption/hardware lock.
