Landlords should get the same amount of time as tenants get.

It says he could be getting fines up to $1000 per day per property but he ought to already be facing them!  In Florida tenants get a three day pay or quit if late on rent.  After that time the landlord can file for eviction.  For everything against the landlord the landlords ought to get that same amount of leeway:  just three days.  After that make them pay with no mercy!  Let THEM show some personal responsibility for THEIR BUSINESS!

DAYTONA BEACH — Landlord Jack Aberman wasn’t at City Hall Tuesday morning to hear a special magistrate’s decision to fine him up to $23,000 per day if he doesn’t move toward securing rental licenses on 23 of his properties this summer.

Aberman also didn’t hear three people who said they rented from him tell Special Magistrate David Vukelja about the mold, rats, broken air conditioners and leaky roofs they said came with Aberman’s rental homes.

AnnElise Treder said rainwater pouring in through the caved-in ceiling of her bedroom in an Aberman home at 311 N. Hollywood Ave. woke her at 4 a.m. one night last year. She said she asked for the ceiling to be fixed for months, and had to make repeated requests to get a functioning stove.

“It is not OK to be able to constantly get away with not making repairs and keep collecting rent,” Treder told Vukelja as she began to cry. “The residential rental license is something citizens should be able to rely on. I never should have been allowed to rent that house.”

Iris Oswald said she also lived at 311 N. Hollywood Ave. for a year, and paid a total of $13,000 in rent.

“I don’t know why they say they don’t have money for repairs,” Oswald said. “I think this is their scam.”

Tuesday’s hearing was the latest chapter in a five-year battle Aberman has had with the city over its requirement for landlords to submit to property inspections and secure residential rental licenses. Aberman owns dozens of beachside rental homes through his company GEA Seaside Investments, but city officials say he has evaded the rental license requirements and fees which would have meant thousands of dollars for the city since the license requirements began in the summer of 2012.

In January, city code inspectors cited Aberman for not having rental licenses for 29 of his properties. The matter went before Vukelja last month, and Aberman appeared at that hearing to deny city officials’ assertion that he was notified of the violations and hearing via certified mail and one hand-delivered notice.

Vukelja delayed the hearing to Tuesday to address the disagreement over proper notice, but only Aberman’s attorney, Joel Osborne, made it to the proceeding. Osborne told Vukelja that in the past few weeks Aberman has started applying for the licenses.

City code enforcement officer Glejuanda Davis said Aberman has applied for five licenses, but those licenses can’t be issued unless he allows the city to inspect the properties and corrects problems if they’re found.

Further, why not put these greedy slumlo9rds in prison for fraud?  After all to rent a place out implies habitability.  If there is mold, rats, and leaks in the ceiling then the place isn't habitable and so the landlord committed fraud by renting out the place as if it were.

It is long past time to get tough on greedy slumlords.

Not true.  Not where demand exceeds supply anyway.  This loser had YEARS to get the permits but ignored the law because he knew he could get away with it for years.  We are far too lenient with these scumbags. 

In this case they only started seriously going after him because the local newspaper started running stories on the blight on the beachside and how these greedy slumlords got thousands in revitalization gimmiedats and then mostly did nothing with the money.

It is time for nationwide rental reform and a set of laws at the federal level.  These laws should provide the minimum protections and rent control with states, counties, and cities free to add additional regulations.

I notice that his big ding is not buying permits from the government, giving them money.  In San Rafael, they LOVE to do surprise inspections of apartments being turned over.  They look for drying wallboard compound.  They fine you for not having painted walls.

Well the local newspaper ran a story about blight a few months back.  Then later they ran a story about how all these landlords got revitalization gimmiedats and how years later the properties were not fixed up.

So FINALLY they went after this guy because he was the biggest offender in getting the gimmiedats and being a slumlord.  It took public embarrassment for the city to finally do something about this.

One big change needed to the law here is that an uninhabitable property needs to be a defense to an eviction.  Right now they made it the only defense for a non-pay eviction is to basically either pay or file proof that the amount is wrong or that you already paid.  So the rof could be falling in (which it IS in this case!) and you could have raw sewage in your living room and the judge can still evict you for not paying the greedy scumbag slumlord.  Florida is way too landlord friendly.

Being an actual landlord, I can tell you that maintenance is a LOT cheaper than doing repairs, so investing in maintenance is a no brainer. 

That said, the ceiling caving in on a tenant story once happened TO ME!  The ceiling caved in and the tenant said she had to move out because the place was unlivable.  It was.

It turned out that there was a roof leak for a long time. Not only did the tenant not report it, she CONCEALED it for years.  She didn't report it because she was afraid I would raise the rent.  She didn't know that the roof was under warranty and that repairs would have cost me NOTHING.

Of course, repairs were made and the unit was reoccupied within a month.  To prevent the problem from happening again, I raised the rents to the highest level in the complex.  Now, the tenants rightly expect the units to be in first class condition and will report any problem immediately, which is just the way I like it.

As it turns out, proper maintenance is not only cheaper, it's MORE PROFITABLE!

If a property or unit is deemed "uninhabitable", nobody should be allowed to inhabit it, right?  In a just society, the occupant should be removed, the unit be made vacant and the unit should be made fit before being available for rent again - at market rate.
